Many towns in Southwest Florida have more gated communities than general neighborhoods. Bonita Springs developers did this so that they could protect the property values and have control over what could be built in those Bonita Springs communities due to open zoning in the county. After a long search for a home, I finally found one I was willing to offer on. My offer was about 22% below the seller’s asking price. The next day my real estate agent informed me that the seller had rejected the offer. Later that day my agent told me that she received an e-mail from the listing agent informing us that our offer was submitted to the seller’s lender for approval on Short Sale. I was quite surprised by this, as there was no hint at all the this home was being sold as a short sale.
I guess I have two questions then:
1. Since we wrote our offer to expire after 48 hours, will the seller’s lender still be able accept our offer, if they wish?
2. Are Sellers/Listing Agents obligated to disclose that a home is a Short Sale?
The seller’s could have been hoping that an offer would come in high enough that it would pay off their loan. Since your offer was not that high they may have decided that they would ask their mortgage company if they would help them sell (by accepting less than a full payoff).
If the sellers list at a price where they can’t sell it without their lender’s co-operation then I believe the seller should disclose that fact.
I never put an expiration time in an offer. There may be a reason in your state that makes that a good idea, but I don’t believe there is in Texas. I can withdraw my offer at any time and I don’t think a time limit makes anyone answer any faster.
It is very important to remember that the seller’s lender will not be "accepting" your offer. The lender is not the seller, they are simply considering if they will accept a short payoff. If you forget this it will lead to headaches in this process.
If you wish to buy a short sale, you may or may not get a good price or a good house. You will get a lot of frustrations. Weeks can go by with no answer to very simple questions. Last minute delays can postpone closing or even cancel what you thought was a binding contract. Terms may be changed even at the last minute. Only buy a short sale if you are able to walk away (even at the last minute) if the "deal" sours.

Your best bet for this type of information is your county records. If they have a website, it can usually be accessed from your city’s/county’s web page.

It sounds like a prudential real estate listing. Try looking up the local prudential office website. I bet they have a "decoder" on their site.
