Today, April 20th, I signed an Agreement of Sale for Residential Real Estate Agreement and my closing date is listed as June 1st. What else is needed by the end of April to qualify for the First-Time Home-buyer Credit and also when do I need to close by?<br />
Additional Information: I do not need a morgage I am paying cash. Also I am using a realtor because the seller is a long time family friend.<br />

What is a HUD -1 statement?<br />
<br />All parties have to sign by the end of April, not just you.</p>
<p>You have to close by the end of June.</p>
<p>The HUD 1 is a document that you will receive at closing, documenting the property itself, identifying you and documenting that title has conveyed from the seller to you.    The title company will give it to you.    You have to send it to the IRS</p>

<br />You should have a real estate agent or an appraiser evaluate it.</p>
<p>The basic strategy is this: Value the home and the business separately. Then combine (don&#8217;t necessarily add) the numbers.</p>
<p>First, what&#8217;s the home worth? If there were no convenience store&#8211;if the house was all that was being sold&#8211;what is it worth today?</p>
<p>Second, what&#8217;s the business worth? There are a number of ways to value a business. First, of course, you take stock on hand. But then the question is valuing the ongoing business. I don&#8217;t like gross sales figures. They tell me (and a buyer) absolutely nothing. With your sales figures of $500,000, you might be making a net profit of $50,000. Or you might just be breaking even. Obviously, the former would be worth a lot more than the latter. Then there&#8217;s the issue of whether the new purchaser would have to hire people to work in the store, or whether the purchaser and his/her family would provide the labor.</p>
<p>Many businesses are valued based on multiples of net profits, or gross sales (which as I said I don&#8217;t like), or some other factor. And that multiple varies by type of business. So, for example, one type of business might sell for 2 times net profits. Another might sell for 3 times net profits.</p>
<p>Many people in your situation actually &quot;ramp up&quot; for a couple of years before selling a business. There are ways&#8211;legally and ethically&#8211;to make your numbers better, thus increasing the value of your business. That&#8217;s something you should consider.</p>
<p>So: Contact a good real estate agent&#8211;one who does commercial real estate as well as residential. He or she should be able to connect you to someone to help you more with the business side of the valuation process.</p>

<br />In the Carribean, there are two approaches to building.  Cheap &amp; flimsy, or rediculously strong.  In that region, both make sense.</p>
<p>With cheap and flimsy, you expect it to be destroyed by a hurricane.  Build cheap and when needed rebuild cheap.  If you want it to survive a hurricane, you need to build rediculously strong.  It will be a heavy cement structure with reinforcing steel bars inside the cement.  Even that is no guarantee, the hurricane can liquify any sand it is on and cause it to sink.</p>
<p>Also remember that the Carribean is a bunch of islands and everyone there operates on &quot;island time&quot;.  Just getting materials to the building site (no less a work crew) is going to be your biggest problem.  Not everything you plan for will be available.  Some islands are MUCH worse than others in this regard.</p>
<p>This is a situation where you shouldn&#8217;t plan ahead.  Go directly to a local builder and see what can be done for you at your particular site.  Is it rocky? Sandy? Flat? Steep? All of those will determine the best way to build on that location.  Is heavy equipment available on this island?  Is there a road to get it to your land?  None of these things should be taken for granted in the Carribean!  Sometimes the most basic things become the most difficult.</p>

I have a client who is going to rent out her 2nd home and she would like me to put in the lease contract &quot;Landlord can force tenant to move when the tenant misses the payment two times.&quot;  I have minimal rental experience, but to me this seems like it is against the law (going around tenant/landlord laws).  Is it enforceable if written into the contract, or is it against the law to include this in the agreement?  Thanks, any help would be appreciated!<br />
<br />Not enforceable.  Landlord would need to evict the tenant for non-payment of rent if the situation arose.</p>

			<content:encoded><![CDATA[<p>•Under new Federal law, tenants have the right to stay until the end of their lease or 90 days from the date of a foreclosure, whichever period is longer, in which to move. You still pay rent for this period but this means you do not have to immediately vacate.</p>
<p>&quot;A new federal statute, enacted in May 2009 as a part of the Helping Families Save Their Homes Act, gives certain qualified tenants the federal right to stay in their homes following a completed foreclosure sale. This new right is generally the opposite of prior law, in which tenants’ and occupants’ rights were terminated along with all other junior liens or claims to the property once the foreclosure sale was complete. The new law provides that the buyer at the foreclosure sale of residential property takes title subject to certain new rights of qualified tenants.</p>
<p>To qualify for protection under this new federal law, the tenant must meet three separate tests: (1) be someone who is not the mortgagor or an immediate family member of the mortgagor; (2) have a lease that was the result of an arms-length transaction; and (3) the lease requires rent that is basically fair market for the property. Exceptions exist if the new owner will occupy the foreclosed property as the new owner’s primary residence and has given the tenant 90 days advance notice that the lease will be terminated. Under the new law, protected tenants must be given 90-day notice to vacate by the new owner. In addition, existing leases must be honored to the end of the remaining term of the lease, with certain exceptions. Qualified tenants without written leases or with leases that can be terminated at will under state laws are also entitled to a 90-day notice to vacate.&quot; </p>
<p>I believe what you received was effective<br />
in starting your 90 day period to run. An open question is the timing of your notice. Were you served before the actual foreclosure sale date.<br />
I believe the 90 days would commence on the sales date. If you were served after the 90 days, you could argue that you deserve 90 days from the date of notice to be allowed the full privilege of the new law&#8230;.<br />
Is this statement true?<br />
<br />I believe the 90 day notice as I read it can be given anytime to a month to month tenant. It also means that a tenant with a signed lease is required to be given ability to stay until the lease is up and must be given 90 day notice as well. Expect it will be given 90 days before lease is up.<br />
Exception: when a new owner will reside in the premises or unit they need only give 90 day notice not be required to allow tenant to live there until end of lease.  Lastly month to month tenants who do not pay rent on time do not have this privilege. They are only required to receive 30 days notice. </p>
<p>Nowhere do I see that notice has to be served after the sale date.  I believe the prospective owner can serve 90 day notice well before closing with the bank once there is a firm contract for purchase.  This only makes sense if the owner needs to live there.</p>
