My husband and I live in a home that will only sell if we list for $40K under market value. We don’t want to sell for that low but need to sell in order to buy our dream home. If a builder could buy our current home for market value we would build with them for a house that is double the price of our current home. Thier incentive would be to make a sell on a $500k house. This happens to be in a new neighborhood where the house would be built and they still haven’t had their first buyer (homes for sale since Janurary 1st, 2007). They’re very motivated, that is why they have chosen to offer $90k in upgrades and perks.

pretty much the same way , first off pick your attorney and contact them asap, most of the time if you and the seller use the same attorney or escrow service you will receive a discount on fees. they will be able to help you follow through with the needed steps so there is nothing that you have overlooked.
a sales contract is a must- with dates such as when closing is expected, when inspections are to be completed, deposits recorded, and any contingencies- even though its a freind your buying from where you take their word for everything- sometimes thats not good enough -if you dont want any unexpected problems to arise later on so its best to get everything IN WRITING. Forms such as home condition disclosures, and lead based paint disclosures will need to be signed and submitted for record – you can gets forms like this from your escrow service, a local real estate agency or even online.
Follow through with your inspections and obtaining a mortgage. If there are any problems that arise – instead of a agent dealing with them- you will have to make the contact and resolve the issues on your own.
Once closing comes – your attorney will make sure everything required including insurance and title insurance is completed.
Real estate agents really are not needed, they act mostly as middle man for making deals and opening the home for showings, if you already know what your buying and follow through with your inspections – and recording papaerwork than everything should go smoothly.
Specifically Texas. Do you really lose out on that deal? It seems as though a buyer should get to decide if he wants to be represented prior to contract. a buyer has no idea that they are signing away their right at that time. ..but my company seems to be pretty set. If I get a call from my realtor that so and so will come out with them to place a contract on a home, I have to tell the realtor to not bother coming. Does anyone else think this is against the law or wrong?

Would depend on MLS rules. Some MLS have made the requirement if a new home plat has a model home manned with site agents & their policy is to only pay selling office commission to agents that accompany their clients to the plat & register said clients with their name (the selling agent), that is called "Site Registration".
In my MLS, any listings that require "site registration" must disclose that in their listings. You will need to call the MLS to see what the rules are for this situation.
Also, it has nothing to do with RESPA. RESPA basically is for "kickbacks".

Is it cheaper to buy a model home from a builder than building that same exact home yourself? Can model home prices be aggressively negotiated? EVery model home that I’ve talked to a sales agent about seem to have a "fixed price" that is very high. Also, I am talking about model homes in the $3 – $4 million range. New home sales are down for the 4th consequetive month in may….does that help?
Yes, it is cheaper but you can’t always get everything you want.
So, I’m supposed to close on a new home in a couple of weeks, and I just got an unsolicited job offer from a company I’ve been wanting to work for with a $12,000/yr raise. I’d have to move, but I haven’t closed on the new house yet, so the timing might be right. Is it wrong to back out of buying the new home? He’s been doing some repairs, so am I liable for the repairs and earnest $$?
Check your contract for any escape clauses, but if it is a good contract, you are going to be responsible for the repairs and will lose your earnest money. You could also be sued for specific performance.
